Terms of Use

Watwet is a social networking service operated and provided by Al Eklimya for Telecom and IT Services, a company registered in the Hashemite Kingdom of Jordan.

BY ACCESSING OR USING THE WEBSITE WWW.WATWET.COM, THE MOBILE VERSION OR SMS THEREOF (TOGETHER THE “WATWET SERVICE”, “WATWET”) YOU SIGNIFY THAT YOU HAVE READ, UNDERSTAND AND AGREE TO BE BOUND BY THESE TERMS OF USE (“TERMS OF USE”), WHETHER OR NOT YOU ARE A REGISTERED MEMBER OF WATWET.

PLEASE READ THESE TERMS OF USE CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES AND OBLIGATIONS. THESE INCLUDE VARIOUS LIMITATIONS AND EXCLUSIONS.

Basic Terms

  1. You must be 13 years or older to use the Watwet website and services.
  2. You are responsible for any activity that occurs under your username and you are responsible for keeping your password secure.
  3. You must not post, share, upload or otherwise make available any content that we deem to be harmful, threatening, unlawful, defamatory, infringing, abusive, inflammatory, harassing, vulgar, obscene, fraudulent, invasive of privacy or publicity rights, hateful, or racially, ethnically or otherwise objectionable.
  4. You must not impersonate any person or entity, or falsely misrepresent yourself, your age or your affiliation with any person or entity.
  5. You must not use or attempt to use another user’s account, service or system.
  6. You are solely responsible for your conduct and any data, text, information, usernames, graphics, photos, profiles, video clips, links (“Content”) that you submit, post, and display on the Watwet service.
  7. You must not modify, adapt or hack Watwet or modify another website so as to falsely imply that it is associated with Watwet.
  8. You must not use Watwet in any unlawful manner or in any other manner that could damage, disable or impair the Site.
  9. You must not create or submit unwanted email to any Watwet members or internet users (“Spam”).
  10. You must not collect email addresses or other contact information of other users from the Service or the Site for the purposes of sending unsolicited emails or other unsolicited communications.
  11. You must not solicit personal information from anyone under 18 or solicit passwords or personally identifying information for commercial or unlawful purposes.
  12. You must not transmit any worms or viruses or any code of a destructive nature by using Watwet.
  13. You must not post, share, upload or otherwise make publicly available any private information of any third party, including, without limitation, addresses, phone numbers, email addresses and credit card numbers.
  14. You must not post, share, upload or otherwise make available content that would constitute, encourage or provide instructions for a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any national or international law.
  15. You must not use Watwet for commercial purposes.

Violation of any of these terms will result in the termination of your Watwet account. While Watwet prohibits such conduct and content on its site, you understand and agree that Watwet cannot be responsible for the Content posted on its web site and you nonetheless may be exposed to such materials and that you use the Watwet service at your own risk.

General Conditions

  1. We reserve the right to modify or terminate the Watwet service for any reason, without notice at any time.
  2. We reserve the right to alter these Terms of Use at any time. If the alterations constitute a material change to the Terms of Use, we will notify you by email or by putting a prominent notice on the Watwet website. What constitutes a “material change” will be determined at our sole discretion, in good faith and using common sense and reasonable judgment.
  3. We reserve the right to refuse service to anyone for any reason at any time.
  4. We may, but have no obligation to, remove Content and accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Use.
  5. The Watwet service makes it possible to post text, images and videos hosted on Watwet to outside websites. This use is accepted. However, pages on other websites which display data hosted on Watwet must link back to Watwet.
  6. We reserve the right to reclaim usernames on behalf of businesses or individuals that hold legal claim or trademark on those usernames.

Copyright

We respect the intellectual property rights of others and we prohibit users from posting, sharing, uploading or otherwise transmitting on Watwet any materials that violate another party's intellectual property rights.

  1. We claim no intellectual property rights over the material you provide to the Watwet service. Your profile and materials uploaded remain yours. You can remove your profile at any time by deleting your account. This will also remove any text videos and images you have stored in the system.
  2. Watwet undertakes to obey all relevant copyright laws. We will review all claims of copyright infringement received and remove content deemed to have been posted or distributed in violation of any such laws. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please send us the following information to the address shown below:
    • an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;
    • a description of the copyrighted work or other intellectual property that you claim has been infringed;
    • a description of where the material that you claim is infringing is located on the site;
    • your address, telephone number, and email address;
    • a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
    • a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner´s behalf.

Limitation of Liability

In no event shall Watwet, its officers, directors, employees or agents be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any (i) errors, mistakes or inaccuracies of content, (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our website. (iii) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein (iv) any interruption or cessation of transmission to or from our website, (v) any bugs, viruses, trojan horses, or the like, which may be transmitted to or through our website by any third party, and or (vi) and errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the Watwet website. The foregoing limitation of liability shall apply to the fullest extent permitted by law.

YOU SPECIFICALLY ACKNOWLEDGE THAT WATWET SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.

Indemnity

You agree to defend, indemnify and hold harmless Watwet, its owners, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney´s fees) arising from: (i) your use of and access to the Watwet service; (ii) your violation of any term of these Terms of Use; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that one of your User Submissions caused damage to a third party. This defense and indemnification obligation will survive these Terms of Service and your use of the Watwet service.

Assignment

These Terms of Service, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Watwet without restriction.

General

You agree that: (i) the Watwet service shall be deemed solely based in Amman, the Hashemite Kingdom of Jordan; and (ii) the Watwet website shall be deemed a passive website that does not give rise to personal jurisdiction over Watwet, either specific or general, in jurisdictions other than the Hashemite Kingdom of Jordan. Any claim or dispute between you and Watwet that arises in whole or in part from the Watwet service shall be decided exclusively by a court of competent jurisdiction located in Amman, the Hashemite Kingdom of Jordan. If any provision of the aforementioned Terms of Use is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Use, which shall remain in full force and effect. No waiver of any term of this these Terms of Service shall be deemed a further or continuing waiver of such term or any other term, and Watwet´s failure to assert any right or provision under these Terms of Use shall not constitute a waiver of such right or provision.
